TRAFFIC INFRACTION RETAINER AGREEMENT FOR ASHBACH LAW OFFICES, LLC

By signing this agreement and returning it to Ashbach Law Offices, LLC (hereinafter “Attorney”), or by completing the online payment form, I agree that I am entering into a flat-fee, contractual agreement for legal services with regards to my infraction(s). The Attorney’s obligation to begin work on my case begins when payment is received. Attorney agrees to provide legal services in connection with such infractions, but does not include appeals. I am aware that if there is an appeal necessary of any ruling, those legal services are not covered by the flat fee agreement.

Rules governing lawyers in Washington requires that any attorney fees must be reasonable according to the current, prevailing professional norms in the area in which the attorney practices. I agree that I had the opportunity to consult with other attorneys and agree that the fee to be charged is reasonable. If for some reason the fee is not reasonable, I am entitled to any amount that is unreasonable under this agreement. The fee that I am paying does not include any court costs, fines or assessments, or other court-imposed money to be paid.

I am aware that if any expert witnesses are required as part of defending my case, I am responsible for those fees.

I hereby authorize Attorney to resolve this matter in whatever manner the Attorney deems appropriate based on Attorney’s professional judgment and experience. I understand that Attorney can make no guarantee as to the outcome of this case such as a dismissal or finding of “not committed,” although that goal sought. I specifically authorize Attorney to resolve my case on my behalf, including but not limited to results such as: a deferred finding, agreed order of continuance, dismissal, or amendment to a violation that will not impact my driving record or insurance. Attorney is authorized to do so if he/she is unable to achieve a dismissal or win the case outright.

Retainer belongs wholly to attorney upon his retention as attorney for the client and is not an advance fee deposit and will not be held in trust. Attorney is not responsible for payment of court costs nor fines out of the retainer. After making payment, I understand that I have the authority to terminate the Attorney-Client relationship, and that I may be entitled to a refund; however, if this occurs, Attorney shall bill at the hourly rate of $200, and I am entitled to my payment has not been earned.
